Compensation for damages (and other remedies)
A
court can award a victim of sexual harassment several remedies. An
employee who has been terminated for complaining of harassment may be
restored to her job. An employee may also receive an award of money for
lost wages and emotional distress caused by the harassment. To justify
such damages, an employee can supply proof that the harassment required
treatment by a psychiatrist. In rare instances, an employee may be
awarded punitive damages if the employer acted with malice. In
California, punitive damages awards of up to nine times the size of the
compensatory damages award may be justified.
Finally, the laws that prohibit sexual harassment allow
payment of attorney’s fees and costs to the employee who prevails at
trial. For this reason, many attorneys are willing to work on a
contingency basis. They may not charge you any money until your case is
settled or won.
